A mediator acts as a neutral third party in a dispute. An arbitrator is also a neutral third party, but they function much as a judge would in court. They will hear arguments and examine evidence from both sides. Then, they will make a final decision on the matter. They can also award damages if the arbitration agreement allows for that. An arbitrator’s decision is final and binding unless the parties have agreed to nonbinding arbitration.
